Terms of Service
Effective date: 17 March 2026
1. About TaskBerry
TaskBerry is a web-based day planner designed to help individuals plan their workday, manage tasks, track time, and use an AI assistant to organise their work more effectively. The service is available at taskberry.app and is operated by Groeien met Gydo, registered in the Netherlands (KvK: 81071698, VAT: NL003525719B18), located at Van Houweningenstraat 70, 1052 TR Amsterdam, The Netherlands.
TaskBerry is offered on three plans: Free, Starter (€1.95/month), and Pro (€4.95/month). Each plan provides access to different features as described in Section 4 and on the pricing page.
2. Acceptance of These Terms
By creating an account or using the TaskBerry service in any way, you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the service.
You must be at least 16 years of age to use TaskBerry. By using the service, you represent and warrant that you meet this requirement.
3. Your Account
To access TaskBerry, you must register for an account. You are responsible for:
- Maintaining the security of your account credentials and any active sessions.
- Notifying us immediately at support@taskberry.app if you become aware of any unauthorised access to your account.
- Ensuring that all information you provide is accurate and kept up to date.
- Any activity that occurs under your account, whether authorised by you or not.
Each account is for a single individual. Account sharing with multiple users is not permitted. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.
4. Plans and Features
TaskBerry is available on the following plans. The current feature set for each plan is detailed on the pricing page.
Free
The Free plan provides basic day planning and task management. It includes a limited feature set and is intended for individual users who want to try TaskBerry at no cost. The Free plan does not include access to the AI assistant or advanced productivity features.
Starter — €1.95/month
The Starter plan includes access to the AI assistant and a set of advanced features designed to support a more structured workday. This plan is billed monthly at €1.95 inclusive of Dutch VAT (BTW) where applicable.
Pro — €4.95/month
The Pro plan includes all features available in TaskBerry, including the hours overview, CSV export, and value statement generation. This plan is billed monthly at €4.95 inclusive of Dutch VAT (BTW) where applicable.
We reserve the right to adjust the features included in each plan at any time. Where changes materially reduce what a paid plan offers, we will provide advance notice as described in Section 16.
5. Payment and Billing
All prices are displayed in euros (EUR) and include Dutch VAT (BTW) where applicable. Payment is processed securely through Stripe. By subscribing, you authorise TaskBerry to charge your payment method on a recurring monthly basis.
- Subscriptions are billed monthly on the date you first subscribed and auto-renew each month unless cancelled.
- If a payment fails, we will retry the charge. After repeated payment failures, access to paid features may be suspended until payment is successfully collected.
- You are responsible for keeping your payment details up to date via the Account page.
- Price changes: we will notify you by email at least 30 days before any price increase takes effect. If you do not accept the new price, you have the right to cancel your subscription before the new price applies. Continued use after the new price takes effect constitutes acceptance.
6. Right of Withdrawal (Herroepingsrecht)
Under EU consumer law (implemented in the Netherlands via Artikel 6:230o BW), you ordinarily have a 14-day right of withdrawal from the date you subscribe to a paid plan.
However, by activating your subscription and immediately accessing paid features, you expressly request immediate performance of the service before the withdrawal period expires. You acknowledge that, once the service has been fully performed during the withdrawal period, your right of withdrawal is forfeited in accordance with Article 6:230p(c) BW.
This acknowledgement is confirmed during the checkout process. If you do not wish to waive your right of withdrawal, do not activate paid features immediately after subscribing.
If you wish to withdraw before accessing any paid features, contact us at support@taskberry.app within 14 days of subscribing and we will issue a full refund.
7. Cancellation
You may cancel your subscription at any time from the Account page in the app. A "Cancel subscription" option is available directly in your account settings — no need to contact support.
- After cancellation, your subscription remains active until the end of the current billing period. No partial refunds are issued for unused time within a billing period.
- When your subscription expires, your account automatically reverts to the Free plan. Your data (tasks, notes, settings) is retained.
- To delete your account and request permanent deletion of your data, contact us at support@taskberry.app. We will process your request within 30 days in accordance with our Privacy Policy.
8. Your Content
You retain all rights to the content you create within TaskBerry, including tasks, notes, context, and other data you input ("Your Content").
By using the service, you grant TaskBerry a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the service to you. This licence terminates when you delete the content or close your account.
We do not claim ownership of Your Content. We do not use your task content or personal data for marketing purposes or to train AI models.
9. Acceptable Use
You agree not to use TaskBerry to:
- Store or transmit illegal, harmful, or unlawful content.
- Attempt to gain unauthorised access to the platform, its infrastructure, or other users' accounts.
- Intentionally overload, disrupt, or degrade the performance of the service.
- Share your account with other individuals (one account per person).
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of the platform.
- Use the service to send spam, conduct phishing, or harass others.
- Access the service using bots, scrapers, or other automated tools in a way that places unreasonable load on the infrastructure or violates these Terms.
Violation of these rules may result in immediate suspension or termination of your account.
10. AI Assistant
TaskBerry's AI assistant is powered by Google's Gemini API. The assistant helps you plan your day, organise tasks, and structure your work. The following conditions apply:
- The AI provides suggestions and assistance. All decisions remain yours. AI output does not constitute professional advice of any kind — including legal, medical, or financial advice.
- The AI may make mistakes. Always review its suggestions before acting on them.
- Do not input sensitive personal data of third parties (such as clients' personal details, identification numbers, or health information) beyond what is strictly necessary for task planning.
- The AI assistant is available on Starter and Pro plans only.
- AI usage is subject to daily request limits, which vary by plan. Limits are set to ensure fair use across all users.
- Your use of the AI assistant is also subject to Google's applicable usage policies.
11. Service Availability
We aim to maintain high availability of TaskBerry but do not guarantee uninterrupted or error-free service. The service relies on third-party infrastructure providers, including Vercel, Supabase, Google, and Stripe.
- Scheduled maintenance will be announced in advance where reasonably possible.
- We may modify, suspend, or discontinue individual features at any time with reasonable notice where the change is material.
- If we discontinue the TaskBerry service entirely, we will provide at least 30 days' advance notice by email and allow you to export your data before the service is shut down.
12. Intellectual Property
TaskBerry, its logo, brand identity, and the underlying platform software are owned by or licensed to Groeien met Gydo. All rights are reserved.
You may not copy, reproduce, distribute, modify, or create derivative works based on the TaskBerry platform or its design without our prior written permission. Nothing in these Terms grants you any licence to our intellectual property beyond the right to use the service as described.
13. Limitation of Liability
To the maximum extent permitted by Dutch law:
- TaskBerry's total aggregate liability to you for any claims arising out of or relating to these Terms or the service shall not exceed the total fees you paid to TaskBerry in the 12 months immediately preceding the event giving rise to the claim.
- We are not liable for loss of data where you have not made use of available data export functionality.
- We are not liable for indirect or consequential losses, loss of profit, loss of revenue, or loss of business opportunity, even if we were advised of the possibility of such losses.
- We are not liable for service disruptions or data loss caused by force majeure events, including natural disasters, strikes, government action, or internet infrastructure failures.
- We are not liable for failures of third-party services on which TaskBerry depends, including Google (Gemini API), Stripe, Vercel, and Supabase.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under Dutch or EU law.
These limitations apply to the maximum extent permitted by applicable law. Nothing in these Terms affects your statutory rights as a consumer under Dutch or EU consumer protection law.
14. Disclaimer of Warranties
The service is provided "as is" and "as available," without warranty of any kind. To the extent permitted by applicable law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or free from viruses or other harmful components, or that it will meet your specific requirements. Output generated by the AI assistant is not guaranteed to be accurate, complete, or suitable for any particular purpose.
15. Privacy
Your use of TaskBerry is also governed by our Privacy Policy, available at taskberry.app/privacy. The Privacy Policy explains what personal data we collect, how we use it, and your rights under the General Data Protection Regulation (GDPR) and Dutch privacy law.
By using the service, you confirm that you have read and understood our Privacy Policy.
16. Modifications to These Terms
We may update these Terms from time to time to reflect changes in the service, applicable law, or our business practices.
For material changes — those that meaningfully affect your rights or obligations — we will notify you by email at least 30 days before the new Terms take effect. The updated Terms will also be posted at taskberry.app/terms with a revised effective date.
Continued use of the service after the effective date of a revised version constitutes your acceptance of the updated Terms. If you do not agree with a change, you may cancel your subscription before it takes effect.
17. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Netherlands (Burgerlijk Wetboek), without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms or the service that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent court in the Netherlands.
If you are a consumer, you may also use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes out of court: ec.europa.eu/odr.
Nothing in these Terms limits your rights under mandatory Dutch or EU consumer protection law, including your right to bring a claim before the Geschillencommissie or a Dutch consumer court.
